BREAKING: DC Court of Appeals Rules President Trump Does Not Have Immunity from Prosecution

On Tuesday, a Democrat-controlled federal appeals court, made up predominantly of Biden-appointed judges, rejected President Trump’s immunity claim in Jack Smith’s J6 case.

Trump is all but certain to promptly ask the US Supreme Court to overturn the ruling, which he must do by February 12.

The three-judge panel for the DC Circuit Court of Appeals adjudicating Trump’s immunity claims included Florence Pan (Biden appointee), Michelle Childs (Biden appointee), and Karen Henderson (George W. Bush appointee).

During the January 9 hearing, a three-judge panel listened to oral arguments and seemed doubtful of Trump’s immunity claims. One judge, appointed by Biden, absurdly asked attorney John Sauer President Trump would be prosecuted if he were to order SEAL Team 6 to take out his political opponents.

“We have balanced former President Trump’s asserted interests in executive immunity against the vital public interests that favor allowing this prosecution to proceed,” the decision read.

“We conclude that ‘concerns of public policy, especially as illuminated by our history and the structure of our government’ compel the rejection of his claim of immunity in this case,” the decision continued.

Meanwhile, the March 4 trial date for Jack Smith’s DC case has been postponed.

Monday night, prior to the appeals court’s decision on presidential immunity, Trump posted a warning on Truth Social about the dangers of stripping a president of total immunity.

IF IMMUNITY IS NOT GRANTED TO A PRESIDENT, EVERY PRESIDENT THAT LEAVES OFFICE WILL BE IMMEDIATELY INDICTED BY THE OPPOSING PARTY. WITHOUT COMPLETE IMMUNITY, A PRESIDENT OF THE UNITED STATES WOULD NOT BE ABLE TO PROPERLY FUNCTION!
