Dominion is accusing Fox News of making false claims that its voting machines rigged the 2020 election; Fox News argues it’s protected by the First Amendment. Dominion is seeking $1.6 billion in damages from the network.
Such cases are usually settled outside of court or dismissed by a court judge, experts say. A Delaware judge ruled that the lawsuit can proceed after Fox’s parent company, Fox Corp., tried to have the lawsuit dismissed.
Fox News expressed confidence that it will succeed in the litigation.

“We are confident we will prevail, as freedom of the press is foundational to our democracy and must be protected, in addition to the damages claims being outrageous, unsupported, and not rooted in sound financial analysis, serving as nothing more than a flagrant attempt to deter our journalists from doing their jobs,” a spokesperson told the Washington Examiner.
Fox Business anchor Maria Bartiromo is scheduled to appear for a deposition on Sept 8. Other top Fox TV hosts have been questioned recently including Sean Hannity, Jeanine Pirro, and Tucker Carlson.
Former Attorney General, William Barr, has also been subpoenaed in the lawsuit.
