The Supreme Court has issued another landmark ruling that deals a major blow to the Biden administration. According to the recent decision, Joe Biden lacks the authority to unilaterally cancel student loan debt, resulting in the dismissal of the administration’s lawsuit.
The ruling followed a 6-3 split along expected political lines.
Benny Johnson and Greg Price both pointed out an interesting aspect, noting that the Supreme Court referenced Nancy Pelosi in their ruling against Biden’s student loan forgiveness plan. The Court emphasized that while the President of the United States can postpone or delay debt payments, the power to forgive debt rests with Congress and requires legislative action.
Radical leftist and card holding idiot Alexandria Ocasio-Cortez claimed:
“It is very important to note this SCOTUS ruling does NOT remove Biden’s ability to pursue student loan forgiveness. The Biden Admin can use the HEA (Higher Ed Act) – our position from the start – to continue loan forgiveness before payments resume. They should do so ASAP.”
Joe Biden implemented a student loan forgiveness program that amounts to over $400 billion. This initiative provides relief to borrowers based on their income levels. Individuals earning $125,000 or less annually may have up to $10,000 in student debt canceled, while recipients of Pell Grants may be eligible for up to $20,000 in debt forgiveness.
Joe Biden faced a lawsuit from six Republican state attorneys general who claimed that the student loan bailout violated the principle of separation of powers. Additionally, two borrowers who were ineligible for Biden’s student loan forgiveness plan filed a separate lawsuit in an attempt to halt the program.
In November, the 8th US Circuit Court of Appeals extended an injunction on Biden’s student loan bailout plan. Subsequently, the Department of Justice (DOJ) requested the Supreme Court to lift the block imposed by the 8th Circuit Court.
Far-left NBC News reported:
The court rejected the Biden administration’s arguments that the plan was lawful under a 2003 law called the Higher Education Relief Opportunities for Students Act, or HEROES Act.
The law says the government can provide relief to recipients of student loans when there is a “national emergency,” allowing it to act to ensure people are not in “a worse position financially” as a result of the emergency.
CBS News quoted Chief Justice Roberts:
“We hold today that the act allows the secretary to ‘waive or modify’ existing statutory or regulatory provisions applicable to financial assistance programs under the Education Act, not to rewrite that statute from the ground up,” Roberts wrote.
The “economic and political significance” of the loan forgiveness plan, Roberts wrote, “is staggering by any measure.”
Conservatives celebrated the ruling, whereas leftists expressed disappointment regarding the absence of a tangible student loan forgiveness program.
Tim Scott tweeted, “Today, SCOTUS made the right decision on student loans. Biden wanted to make waitresses & mechanics pay the student loans of doctors & lawyers who make six figures. If you take out a loan, you pay it back. It’s time for a President who values hard work & the people who do it.”
Dinesh D’Souza, a conservative filmmaker and commentator, praised the decision as a “massive ruling.”
Sean Davis, CEO of the Federalist magazine, tweeted the Supreme Court’s decision “nuked Biden’s unconstitutional college debt cancellation scheme.”
Journalist and former Fox News host, Megyn Kelly, took to Twitter to express her opinion, stating that it is “A spectacular day for Donald Trump whose three conservative picks for SCOTUS were integral to the historic decisions yesterday and today. Major feather in his cap and will likely (& rightfully) be touted by his campaign in coming months.”
Jack Posobiec, senior editor of Human Events, wrote, “Under this Supreme Court Roe v Wade = GONE Affirmative Action = GONE Student Loan Forgiveness = GONE Constitutional Carry = SECURED Business Religious Freedom = SECURED Say those 4 little words: Thank you, Donald Trump.”
Richard Baris, political pundit and pollster, shared similar sentiments, tweeting, “Without a doubt” in agreement with statements attributing these rulings to the selection of conservative justices by the Trump administration.
