During the unprecedented raid of President Trump’s home at Mar-a-Lago, the FBI took boxes of allegedly classified documents.
Trump’s team claims they were declassified. Additionally, a motion filed by Trump’s attorneys on Aug. 22 argued that the DOJ could not be trusted, and because of this, an impartial “Special Master” was needed to review the documents “to preserve the sanctity of executive communications and other privileged materials.”
Judge Aileen Cannon granted Trump’s request for a special master and in response the DOJ filed for the motion to be “partially stayed,” arguing that the appointment of an impartial third party would cause “irreparable harm” to both the government and the public.
The laughable arguments by the DOJ weren’t lost on the Trump team.
According to a countermotion filed by Trump’s team, such risks to the public and government are greatly exaggerated, and in fact, the one party actually at risk of facing “irreparable harm” in this case is Trump himself if a special master is not appointed.
“Irreparable injury could most certainly occur if the Government were permitted to improperly use the documents seized,” the motion read.
But the real blow was delivered when Trump’s lawyers pointed out how the DOJ is misinterpreting the Presidential Records Act. According to experts, Trump always had a right to hold onto the Mar-a-Lago documents, classified or declassified, which renders the DOJ raid of Mar-a-Lago unnecessary and suggests that it was an abuse of power.
No wonder they’re fighting so hard to stop a neutral third party from reviewing the documents.
Multiple experts believe this latest motion completely destroys the DOJ’s argument.
Margot Cleveland, the Federalist’s senior legal correspondent, tweeted her explanation of why President Trump “committed no crime”.
“9/9 there was no crime, so they had to create one,” Cleveland tweeted.
Mike Davis, former Chief Counsel for Nominations to Senate Judiciary Chairman, Chuck Grassley, agreed.
“President Trump’s legal team filed and excellent legal brief, calling out the Biden Justice Department’s political charade.”
“Team Trump is firing on all cylinders.”
“Trump clearly has the winning legal argument.”
