Retired U.S. Marine Daniel Penny surrendered on Friday morning to New York City police.
Neely, a homeless 30-year-old with an extensive criminal record, threatened the lives of passengers on a train in Manhattan on May 1. Penny put him in a chokehold which led to Neely’s death.
The medical examiner’s office declared Neely’s death a homicide the following day.
Protesters demanded Penny be charged for Neely’s death. Today Penny surrendered to authorities and was charged with second degree manslaughter.
Penny could face up to 15 years in prison for defending his and the lives of the other passengers on the train.
After Neely’s death, a video surfaced showing him spewing homophobic slurs at a man before violently attacking him.
The crowd on the train expressed their gratitude to Penny for acting in their defense against Neely.
