Judge Cannon DENIES Jack Smith’s Request for Second Gag Order, Warns of Possible Sanctions if Violations Persist

On Tuesday, Judge Aileen Cannon rejected Special Counsel Jack Smith’s Friday motion, which sought to bar Trump from criticizing law enforcement, following the revelation that Biden’s DOJ authorized the use of deadly force during the Mar-a-Lago raid.

Late Friday night, Jack Smith sought a gag order to prevent Trump from criticizing Biden’s DOJ and FBI.

Although the names of the armed FBI agents involved in the Mar-a-Lago raid were redacted, Jack Smith, nonetheless, attempted to gag Trump.

“The Government moves to modify defendant Donald J. Trump’s conditions of release, to make clear that he may not make statements that pose a significant, imminent, and foreseeable danger to law enforcement agents participating in the investigation and prosecution of this case.,” Jack Smith’s motion read.

“The Government’s request is necessary because of several intentionally false and inflammatory statements recently made by Trump that distort the circumstances under which the Federal Bureau of Investigation planned and executed the search warrant at Mar-a-Lago,” Jack Smith wrote.

The judge overseeing Donald Trump’s classified documents case in Florida on Tuesday denied prosecutors’ request to bar the former president from making public statements that could endanger law enforcement agents participating in the prosecution.

U.S. District Judge Aileen Cannon said in her order that prosecutors didn’t give defense lawyers adequate time to discuss the request before it was filed Friday evening. She denied the request without prejudice, meaning prosecutors could file it again.

Cannon warned that sanctions could be next if Jack Smith’s prosecutors continue to violate the rules.

Trump’s lawyers argued that Jack Smith violated Southern District of Florida Local Rule 88.9, which states that parties must meet and confer before filing motions.

She likewise denied a motion from Trump’s legal team seeking to censure prosecutors over the matter.

Trump’s lawyers fired back Tuesday, after Smith asked the judge to put a stop to his false claims that FBI agents had a green light to assassinate him during their search for documents at the former president’s Mar-a-Lago resort in Florida.

A late Friday filing from the Justice Department pointed to what it deemed “several intentionally false and inflammatory statements” that violate existing limitations placed on Trump as part of his conditions of pretrial release.

Prosecutors — who, like Trump’s team, are required to confer with the other party before filing motions in the case — did not do so until 5:30 p.m. ahead of Memorial Day weekend.
