Attorneys for Hunter Biden may face sanctions after providing false information to the clerk in the criminal case concerning Joe Biden’s embattled son. According to a report from the Daily Mail, Delaware Judge Maryellen Noreika has directed Biden’s legal team to offer an explanation by 9 p.m. Tuesday or else they may be subject to sanctions.
Monday, House Ways and Means Committee Chairman Jason Smith filed a motion, urging the judge to dismiss Hunter Biden’s lenient plea agreement on misdemeanor tax charges. Smith, like numerous other critics, argued that the Joe Biden’s son was granted preferential treatment.
Per the allegations, an individual from the former law office of Hunter Biden’s attorney, Chris Clark, made a call to Delaware clerk Sam Grimes, falsely claiming to be from the office of Smith’s attorney, Theodore Kittila. The individual allegedly requested the removal of the original filing and 448 pages of Congressional testimony provided by two IRS whistleblowers involved in the case, as reported by the Daily Mail.
Subsequently, the documents were removed and sealed, leading to a second letter of outrage from Kittila. In the letter, Kittila wrote, “We promptly contacted the clerk’s office, and we were advised that someone contacted the court representing that they worked with my office and that they were asking the court to remove this from the docket.”
In an email response, Clark denied the allegations and asserted that “the clerk took the filing down on their own accord.”
However, Kittila provided evidence supporting his claims by including a copy of an email from the Delaware clerk. The email confirmed the incident and identified the individual responsible as Jessica Bengels, along with her phone number. The clerk’s email stated that Bengels claimed to work with Theodore Kittila and emphasized the urgent need for the document’s immediate removal.
In response to the dirty trick, Judge Noreika demanded an explanation from Hunter’s lawyers. “It appears that the caller misrepresented her identity and who she worked for in an attempt to improperly convince the clerk’s office to remove the amicus materials from the docket,” the order said.
“Therefore, it is hereby ordered that, on or before 9pm today on July 25, 2023, counsel for defendant shall show cause as to why sanctions should not be considered for misrepresentations to the court.”
The judge did take the step of temporarily sealing Smith’s filing, indicating that it will remain confidential until the conclusion of Hunter Biden’s plea hearing on Wednesday.
It’s worth noting that, while the Judge was nominated by President Trump, she is also a Democrat and previously ruled against the laptop repairman in the Hunter Biden case.
