Forensic Report Confirms Jocelyn Nungaray was Sexually Assaulted, Making Her Killers Eligible for the Death Penalty

Forensic evidence confirms 12-year-old Jocelyn Nungaray was sexually assaulted before she was murdered and her body dumped in a bayou, according to reports.

KTRK-TV, citing unnamed sources, reported that results from the Houston Forensic Science Center (HFSC) confirmed that sexual assault took place.

The Harris County District Attorney’s Office received the results from HFSC on Sunday. on Sunday, the outlet reported.

Illegal aliens Johan Jose Martinez-Rangel, 22, and Franklin Jose Peña Ramos, 26, have been charged with murder in connection with Jocelyn’s death.

Harris County District Attorney Kim Ogg had said that if sexual assault was found, the case would be upgraded to Capital Murder, making it death penalty eligible.

Both suspects are currently under U.S. Immigration and Customs Enforcement (ICE) holds. This means that even if they were to post bond, they would not be able to leave.

According to the agency, the U.S. Border Patrol arrested Martinez-Rangel near El Paso on March 14 and Pena was arrested on May 28, also near El Paso. Both illegals were released the same day they were arrested with notices to appear in court at a later date.

Prosecutors said Martinez-Rangel shaved his facial hair after murdering Jocelyn in order to avoid being recognized.
